These Terms of Use (the "Terms") set out the conditions for using the app "Mokumoku (Reading Bank)" (formerly BookBank) and its related web pages (together, the "Service") provided by Ryo Tsuzukihashi (the "Operator"). By using the Service, you agree to these Terms.
Article 1 (The Service)
The Service lets you record the books you buy, their prices and your reading notes, and review them with totals.
Your records are, as a rule, stored on your own device. If you create an account or subscribe to the paid plan, you can use the features described in the following articles.
Article 2 (Accounts)
When you start using the Service, you choose whether to sign in with your Apple ID or Google account, or to start as a guest. Even as a guest, an anonymous account (user ID) is created for features such as friends. Guests can become friends, view bookshelves and receive recommendations, but cannot create their own bookshelf or recommend books to other users. Backup is available when you sign in with your Apple ID or Google account. Guests can connect an Apple ID or Google account later.
If you sign in with an Apple ID or Google account, you can also connect the other one to the same account. If you lose access to one of them, you can sign in with the other and return to the same account. You cannot connect an account that is already used by another account of the Service.
You are responsible for managing your account and must not let any third party use it.
You can delete your account at any time from My Page in the app. When you delete it, the data stored on the Operator's servers is erased and cannot be restored.
Article 3 (Paid plan)
The Service offers an auto-renewing subscription, the "Super Mokumoku Plan" (the "Paid Plan"). The price, period and contents are shown on the purchase screen.
Payment is made through the store where you got the app (Apple's App Store or Google Play). Your account for that store is charged when you confirm the purchase.
The Paid Plan renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. On iPhone and iPad, go to Settings → Apple ID → Subscriptions; on Android, go to Google Play → Payments & subscriptions → Subscriptions.
Refunds after purchase follow the rules of each store. The Operator cannot issue refunds directly.
When the Paid Plan ends, features exclusive to it become unavailable and the passbook design returns to the standard one. Backups deposited on the server are deleted 7 days after the plan ends. If you return to the Paid Plan before then, they are not deleted.
Article 4 (Bookshelves, friends and recommendations)
The bookshelf, friends, recommendations and favorites features (the "Bookshelf Features") are available to people aged 13 and over. When you start using the Bookshelf Features, your age is checked (on iPhone and iPad, Apple's age range sharing may be used) and you agree to the bookshelf rules (not posting anything that makes other users uncomfortable, how blocking and reporting work, and so on). People under 13 cannot use the Bookshelf Features.
Users can put books they choose from their records, with a short comment on each, on their bookshelf. You can choose who can see your bookshelf: Hidden, Friends only or Public. A public bookshelf is listed in the app's Everyone list and can be seen by anyone who uses the app. Amounts and reading notes are never put on the bookshelf.
Users can send friend requests with a friend code, and become friends when the other user accepts. Friends can send each other books with a short message as recommendations.
Users can add other users' bookshelves to their favorites. When you do, the owner of the bookshelf receives a notification, and the number of favorites is shown on the bookshelf. When new books are added to a bookshelf in your favorites, you receive a notification.
The name and comment on your bookshelf, comments on books and recommendation messages are shown to other users. Do not write content that infringes others' rights, that may make others uncomfortable, or that aims to exchange contact details or solicit. The Operator may refuse posts containing clearly inappropriate words. The Operator has zero tolerance for posts or users that harass other users or make them uncomfortable.
Users can block and report other users. Blocking or reporting a user removes them from your friends, and you can no longer see each other's bookshelves. The Operator reviews reports within 24 hours and removes inappropriate posts, removes bookshelves from the Everyone list, stops their display, suspends the use of the Bookshelf Features or deletes the account. A bookshelf reported by several users is removed from the Everyone list until it has been reviewed. You can unblock users from "Blocked users" on My Page.
Article 5 (Links to bookstores)
The Service may show links to pages where you can buy books. Some links are part of affiliate programs, and the Operator may receive a referral fee when you buy through them. The amount you pay does not change.
Purchases, delivery and returns at linked bookstores are governed by each store's terms.
Article 6 (Prohibited conduct)
- Acts that violate laws or public order and morals
- Acts that infringe the copyrights, portrait rights, privacy or other rights of other users or third parties
- Impersonating other users, harassment or defamation
- Using the friends or recommendation features for advertising, promotion or solicitation
- Placing an excessive load on the Service's servers or network, or accessing them without authorization
- Disassembling or modifying the Service, or using it in ways the Operator does not intend
- Any other conduct the Operator deems inappropriate
Article 7 (Suspension)
If you violate these Terms, the Operator may, without prior notice, suspend all or part of your use of the Service and delete your account.
Article 8 (Changes to and end of the Service)
The Operator may change the Service or end it without notifying users. If the Paid Plan is discontinued, users will be notified in advance, for example in the app.
Article 9 (Disclaimer)
The scope of the Operator's responsibility for the Service is set out in the separate Disclaimer. Except in cases of the Operator's intent or gross negligence, the Operator is not liable for damages arising from your use of the Service.
Article 10 (Changes to these Terms)
The Operator may change these Terms as needed. The changed Terms take effect when they are posted on this page.
Article 11 (Governing law and jurisdiction)
These Terms are governed by the laws of Japan. Any dispute regarding the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance. However, if the laws of the country where you live provide otherwise, those laws apply.
